Hunting: A Poem

Hunting

The deer, leaned over, frightens

at the sound of the crack,

the broken stick beneath his  hoofs

or the hunter’s feet.

Wagging his tongue in the  moonlight,

shaking his fist at the sky,

the hunter loses choice and  chance.

A moment later

it would have been gunfire:

the sound

either unreal or untrue

that cannot be heard

except by the living.

A crisp cool tug of air,

like the long drag of a  cigarette,

wisps across the earth,

slaps him  in his face,

reminds him

of the coming cancer.

He looks through the sights, down  the barrel,

and fires at the nothing that’s there

to kill the something that is,

the sum of his existence,

and ours:

hope and truth.

The Glass Eye

Acting like you come

to pet my dog Bullet

No Sir Little Missy

you come to lookit

the quarter-sized hole

in my head

where my glass eye lives.

 

‘Jack in the Box Joe’

I call him.

Pops just like Jack

out of his tin box,

or dentures

From my mouth.

Hold out your hand

I’ll drop him to your palm

go on

he won’t bite.

 

Girl, slow your jabbering down.

Did Jack in the Box Joe

ever fall out my head

when he wasn’t supposed to?

 

Three springs back

Tornado Juanita

drove trucks, trailers

Big Lots!

ten counties over;

that wind a noodler’s arm

yanking Joe out my socket,

Joe a catfish

bunkered deep the nest

of my skull.

 

Campground Twelve,

Lake Shawnee,

Jack in the Box Joe plunked

Right smack that

memory foam posture pedic queen

lodged the top

an old oak.

 

Last June

International Youth Rodeo Finals,

lost my eyeball

Expo building.

 

Youth barrel racing

starting up–

old Joe roll behind a saddle stall,

a miracle that loudspeaker,

            Rodeo fans

            we got us one navy purse

            an eyeball turned in

            Anyone missing an eye

            Or lady’s purse

            Go left of Roy’s Funnel Cakes

            Right of Connie’s Chicken Gizzard Wagon;

            Again, anyone lost an eyeball

            Assert to Rodeo lost and found.

 

Jack in the Box Joe

plopped back in

that empty space

in my head

Joe all grateful,

sputters a little

            Thanks Man,

Joe going hippie

on me

sometimes.

 

Do I have to clean him

since he’s made of glass?

Windex, a paper towel

spit-shines Joe

clear as a prize blue marble

or show Corvette.

 

How did I get the nickname

“Eyeball-Satellite?”

Joe and me

we spot rain

good as a NASA satellite.

Rain, sleet twenty counties away,

the glass eye twitches.

 

If Jack in the Box Joe

knew stocks like he knows rain

I’d be rich  

as Wal-Mart clan,

Bentonville area.

 

Did you know Alice Walton

got herself a DUI

Christmas 2012?

Forth Worth ranch,

I-35.

Miss Alice

coulda splatted

like a water bug,

liquor a respecter

of no one.

 

Watch Little Miss Amy Susan;

My eye’s gonna twitch.

Rain our way come this hour.

Best to scoot on home

eat your Mama’s

corndog, okra supper.

 

Oh foo and poo

fiddle stickers to boot,

you think I could make this up?

Joe and me

got to feed Bullet his Purina

I mix with a little Swanson’s

scoot home girl–

beat the rain,

Bottle Tree

My Nanna’s backyard elm

outfitted with blue, red

green glass bottles

tied with chicken wire the width

of a hen’s beak

to each branch.

 

            Scarin’ crows away,

Gram’s explained.

Wind chimes hung like gaudy ear bobs

from lobes of lower branches:

a lady bug with silver spoons,

that copper kettle adorned with

aqua beads, a faded red tin cup,

the kind hobos carry

while riding the rail.

 

Each sunset

those Blue Nun bottles

soft purple

like a mood ring

or Goddess moon from Jupiter.

          Mama back at Griffin,

I’d sigh,

run my palm

down the spine

of charcoal bark.

 

I never told Nanna,

kids at school

just Ruby-Lucille

me winning

a big red Escalade

Firelake Casino

someday I would—

 

Mama and me

we’d chomp green M&Ms

all the way to California,

big blue ice chest

the kind with wheels

loaded with biscuits

Pepsi, Paydays

strawberry ice cream bars galore.

 

Grams calls Griffin

          A  nerve hospital

           A mini-vacation from life.

 

Church ladies whisk

meatloaf

salisbury steak

Sunday afternoons,

          Grams too old to handle a child

          This stage of life

          All by herself.

Subject: Civil suit
 
We’ve read the facts pursuant to the case
regarding your late husband’s sad demise.
Regretfully, a lawsuit has no trace
of merit and therefore we do advise
that evidence a-plenty proves his fall
occurred while in commission of a crime.
No fault accrues to Pig and Pig, et al.
No damages are due you at this time.
        His huffing and his puffing further show
        a pre-existing illness and although
        this wasn’t cause of death it surely must
        support that bringing suit would be unjust. 
        Your husband died attempting a break-in
         and so this suit is one you cannot win.

Subject: Pumpkineater v. Pumpkineater
 
My client in an affidavit swears
that he confined his faithless wife because
she had indulged in numerous affairs –
he didn’t think he’d broken any laws.
Her infidelities made him so sad
and left him feeling helpless, in disgrace;
in fact, you might say that she drove him mad
by throwing her amours smack in his face.
These acts diminished his capacity
        to tell right from wrong. Her audacity
        impelled him to this deed.  He does regret
        his rashness and hopes she can just forget,
        forgive and drop the charges that she brought.
        He simply was distressed and overwrought.

when Peter, in a fit of jealous rage,
confined her in a fetid pumpkin shell

She swears that she was faithful, always true
and kept her marriage vows although her mate

He threatened violence if she came home late.
        She’s willing to drop charges and agree
        to just divorce the beast, let him go free.
        She wishes he would suffer as she did
        but asks for nothing more than to be rid
        of this abusive, cruel and jealous spouse.
        Oh, by the way, she wants the car and house.
 
 
 
Subject: State v. Farmer’s Wife
 
Regarding claims by Mouse and Mouse and Mouse:
details of their de-tailing do support
the charge against the farmer’s vicious spouse.
We demand this case be tried in court.
The victims all are visually impaired
and wandered by pure chance across her path.
Under oath they all have so declared, 
but she responded with unbridled wrath!
        It’s clear she meant to take each Mouse’s life,
        her WMD a carving knife.
        We know that rodents often are maligned.
        We know society neglects the blind. 
        The only way the Mice will be requited
        is if their assailant is indicted.
 
 
 
Subject: Name Change
 
The miller’s daughter to my great surprise
has ruined my business plan – a sort of game
that asked contestants to vie for a prize
by guessing my most strange and secret name.
How that was managed she would never tell –
it’s not as if I bandied it about.
But she’s the queen and my plan’s shot to hell.
It looks as if my luck has just run out.
        I had ideas – big ones – they’re all a bust.
        She found me out so I must now adjust.
        I’ve given it much thought and I’ve assessed
        the possibilities that won’t be guessed. 
        Please amend the records; let them show
        that my last name is Stiltskin, first name Joe.

Some Poetry by Oliver Wendell Holmes, Jr.

The following lines come from two dissents by Oliver Wendell Holmes, Jr.  I have rendered the lines in poetic form to suggest that Holmes’s writing is poetic, perhaps even inspired by Modern American poets such as William Carlos Williams.

Black & White Taxi & Transfer Co. v. Brown & Yellow Taxi & Transfer Co.[1]

A Poem[2] (1928)

It is very hard to resist the impression

that there is one august corpus

to understand which clearly is the only task

of any Court concerned.

If there were such a transcendental body of law

outside of any particular State

but obligatory within it unless and until changed by statute,

the Courts of the United States might be right in using

their independent judgment

as to what it was.

But there is no such body of law.

The fallacy and illusion that I think exist

consist in supposing that there is this outside thing to be found.

Law is a word used with different meanings,

but law in the sense in which courts speak of it today

does not exist

without some definite authority

behind it.

 

Gitlow v. New York[3]

A Poem[4] (1925)

Every idea

is an incitement.

It offers itself for belief

and if believed

it is acted on

unless some other belief

outweighs it

or some failure of energy

stifles the movement

at its birth.

The only difference

between the expression

of an opinion and an incitement

in the narrower sense

is the speaker’s enthusiasm

for the result.

Eloquence may set fire

to reason.

But whatever may be thought

of the redundant discourse

before us

it had no chance of starting

a present conflagration.

Emersonian Individualism

Ralph Waldo Emerson is politically elusive. He’s so elusive that thinkers from various schools and with various agendas have appropriated his ideas to validate some activity or another. Harold Bloom once wrote, “In the United States, we continue to have Emersonians of the Left (the post-Pragmatist Richard Rorty) and of the Right (a swarm of libertarian Republicans, who exalt President Bush the Second).”[1] We’ll have to excuse Bloom’s ignorance of political movements and signifiers — libertarians who exalt President Bush, really? — and focus instead on Bloom’s point that Emerson’s influence is evident in a wide array of contemporary thinkers and causes.

Bloom is right that what “matters most about Emerson is that he is the theologian of the American religion of Self-Reliance.”[2] Indeed, the essay “Self-Reliance” remains the most cited of Emerson’s works, and American politicians and intellectuals selectively recycle ideas of self-reliance in the service of often disparate goals.

Emerson doesn’t use the term “individualism” in “Self-Reliance,” which was published in 1841, when the term “individualism” was just beginning to gain traction. Tocqueville unintentionally popularized the signifier “individualism” with the publication of Democracy in America. He used a French term that had no counterpart in English. Translators of Tocqueville labored over this French term because its signification wasn’t part of the English lexicon. Emerson’s first mention of “individualism” was not until 1843.

It is clear, though, that Emerson’s notion of self-reliance was tied to what later would be called “individualism.” Emerson’s individualism was so radical that it bordered on self-deification. Only through personal will could one realize the majesty of God. Nature for Emerson was like the handwriting of God, and individuals with a poetical sense — those who had the desire and capability to “read” nature — could understand nature’s universal, divine teachings.

Lakes, streams, meadows, forests — these and other phenomena were, according to Emerson, sources of mental and spiritual pleasure or unity. They were what allowed one to become “part and parcel with God,” if only one had or could become a “transparent eyeball.” “Nothing at last is sacred,” Emerson said, “but the integrity of your own mind.” That’s because a person’s intellect translates shapes and forms into spiritual insights.

We cannot judge Emerson exclusively on the basis of his actions. Emerson didn’t always seem self-reliant or individualistic. His politics, to the extent that they are knowable, could not be called libertarian. We’re better off judging Emerson on the basis of his words, which could be called libertarian, even if they endow individualism with a religiosity that would make some people uncomfortable.

Emerson suggests in “Self-Reliance” that the spontaneous expression of thought or feeling is more in keeping with personal will, and hence with the natural world as constituted by human faculties, than that which is passively assumed or accepted as right or good, or that which conforms to social norms. Emerson’s individualism or self-reliance exalted human intuition, which precedes reflection, and it privileged the will over the intellect. Feeling and sensation are antecedent to reason, and Emerson believed that they registered moral truths more important than anything cognition could summon forth.

Emerson’s transcendentalism was, as George Santayana pointed out in 1911, a method conducive to the 19-century American mindset.[3] As a relatively new nation seeking to define itself, America was split between two mentalities, or two sources of what Santayana called the “genteel tradition”: Calvinism and transcendentalism.

The American philosophical tradition somehow managed to reconcile these seeming dualities. On the one hand, Calvinism taught that the self was bad, that man was depraved by nature and saved only by the grace of God. On the other hand, transcendentalism taught that the self was good, that man was equipped with creative faculties that could divine the presence of God in the world. The Calvinist distrusted impulses and urges as sprung from an inner evil. The transcendentalist trusted impulses and urges as moral intuition preceding society’s baseless judgments and prevailing conventions.

What these two philosophies had in common was an abiding awareness of sensation and perception: a belief that the human mind registers external data in meaningful and potentially spiritual ways. The Calvinist notion of limited disclosure — that God reveals his glory through the natural world — played into the transcendentalists’ conviction that the natural world supplied instruments for piecing together divinity.

The problem for Santayana is that transcendentalism was just a method, a way of tapping into one’s poetical sense. What one did after that was unclear. Santayana thought that transcendentalism was the right method, but he felt that Emerson didn’t use that method to instruct us in practical living. Transcendentalism was a means to an end, but not an end itself.

According to Santayana, Emerson “had no system” because he merely “opened his eyes on the world every morning with a fresh sincerity, marking how things seemed to him then, or what they suggested to his spontaneous fancy.”[4] Emerson did not seek to group all senses and impressions into a synthetic whole. Nor did he suggest a politics toward which senses and impressions ought to lead. Santayana stops short of accusing Emerson of advancing an “anything-goes” metaphysics. But Santayana does suggest that Emerson failed to advance a set of principles; instead, Emerson gave us a technique for arriving at a set of principles. Emerson provided transportation, but gave no direction. This shortcoming — if it is a shortcoming — might explain why Bloom speaks of the “paradox of Emerson’s influence,” namely, that “Peace Marchers and Bushians alike are Emerson’s heirs in his dialectics of power.”[5]

For Emerson, human will is paramount. It moves the intellect to create. It is immediate, not mediate. In other words, it is the sense or subjectivity that is not yet processed by the human mind. We ought to trust the integrity of will and intuition and avoid the dictates and decorum of society.

“Society,” Emerson says, “everywhere is in conspiracy against the manhood of every one of its members.” Society corrupts the purity of the will by forcing individuals to second-guess their impulses and to look to others for moral guidance. Against this socialization, Emerson declares, “Whoso would be a man, must be a nonconformist.”

Emerson’s nonconformist ethic opposed habits of thinking, which society influenced but did not determine. Emerson famously stated that a foolish consistency is the hobgoblin of little minds. What he meant, I think, is that humans ought to improve themselves by tapping into intuitive truths. Nature, with her figures, forms, and outlines, provides images that the individual can harness to create beauty and energize the self. Beauty therefore does not exist in the world; rather, the human mind makes beauty out of the externalities it has internalized. Beauty, accordingly, resides within us, but only after we create it.

Here we see something similar to Ayn Rand’s Objectivism stripped of its appeals to divinity. Rand believed that reality existed apart from the thinking subject, that the thinking subject employs reason and logic to make sense of experience and perception, and that the self or will is instrumental in generating meaning from the phenomenal world. Transcendence

Descending from the mountains, down the plain,

Into the valley, I have found a cave

To live in and to contemplate my pain

And joy, the love and strife designed to save

Me from my selfishness, to be reborn.

Do not mistake my constant strong desire –

The animal is transformed to adorn

The unity whose friction brings the fire

Of love out of apparent fleshly lust,

Erecting a true temple to embrace

The higher life of love and joy and trust

That life will lead me right and bring me grace.

When I want to make love to you it’s so

Our spirits can emerge and merge and grow.

 

Made, and Made Anew

The stones are worn with even, weary waves –

The ships are rusting by the rotting dock

That constitutes their cold, collective graves –

As weather runs down every object’s clock.

I look at you, your each new crease and gray –

The sand swirls, eddies up around your feet

With waves which wash so no sand, stone will stay

The way or where it is with every beat.

And yet our children play and chase the birds

That live with what the waves stir up. The seals

Are nursing pups. Sea grass will feel the herds

Of deer who make for cougar mothers’ meals.

Destruction is a part of nature, true –

But first things must be made, then made anew.

 

Lost Girl

She had the words. She knew she had the words.

They forested her, dimmed the light. Her limbs

Spread, palms outstretched to block her movement. She

Had no idea which way to go. She cut

The roots, expecting she would float away –

She tumbled, crushed the touch-me-nots. Brown seeds

Shot out from curling pods. Forget-me-nots

As blue as bluets made mere scents of crushed

Herbaceousness the moment her trunk landed.

So certain, she set out, discovering

New lands – she named new things – but she will not

Return to tell us what she saw. No blaze

Was ever made. She’ll be forgotten, turn

To soil, become the forest floor, mere food F

or fungi. The words will mould, fertilize

A future poetry upon her bones.

She had the words – for one of future’s branches –

Should other poets trim the tree just right

With all their wind and lightning, rhythmic storms

That shape the art by felling forests. Then

She’ll be discovered, newly unforgotten.

The Emersonian Oliver Wendell Holmes Jr.

Writers on Holmes have forgotten just how influential poetry and literature were to him, and how powerfully literary his Supreme Court dissents really are.  The son of the illustrious poet by the same name, young Holmes, or Wendell, fell in love with the heroic tales of Sir Walter Scott, and the “enthusiasm with which Holmes in boyhood lost himself in the world of Walter Scott did not diminish in maturity.”[1]  Wendell was able to marry his skepticism with his romanticism, and this marriage, however improbable, illuminated his appreciation for ideas past and present, old and new.  “His aesthetic judgment,” says Mark DeWolfe Howe, author of the most definitive biography of Holmes and one of Holmes’s former law clerks, “was responsive to older modes of expression and earlier moods of feeling than those which were dominant at the fin de siècle and later, yet his mind found its principle nourishment in the thought of his own times, and was generally impatient of those who believe that yesterday’s insight is adequate for the needs of today.”[2]  Holmes transformed and adapted the ideas of his predecessors while transforming and adapting—one might say troping—milestone antecedents of aestheticism, most notably the works of Emerson.  “[I]t is clear,” says Louis Menand, “that Holmes had adopted Emerson as his special inspiration.”[3]      

Classically educated at the best schools, Wendell was subject to his father’s elaborate discussions of aesthetics, which reinforced the “canons of taste with the heavier artillery of morals.”[4]  In addition to Scott, Wendell enjoyed reading Sylvanus Cobb, Charles Lamb’s Dramatic Poets, The Prometheus of Aeschylus,[5] and Plato’s Dialogues.[6]  Wendell expressed a lifelong interest in art, and his drawings as a young man exhibit a “considerable talent.”[7]  He declared in his Address to the Harvard Alumni Association Class of 1861 that life “is painting a picture, not doing a sum.”[8]  He would later use art to clarify his philosophy to a friend: “But all the use of life is in specific solutions—which cannot be reached through generalities any more than a picture can be painted by knowing some rules of method.  They are reached by insight, tact and specific knowledge.”[9]     

At Harvard College, Wendell began to apply his facility with language to oft-discussed publications in and around Cambridge.  In 1858, the same year that Dr. Oliver Wendell Holmes Sr. gifted five volumes of Emerson to Wendell,[10] Wendell published an essay called “Books” in the Harvard undergraduate literary journal.[11]  Wendell celebrated Emerson in the piece, saying that Emerson had “set him on fire.”  Menand calls this essay “an Emersonian tribute to Emerson.”[12] 

Holmes had always admired Emerson.  Legend has it that, when still a boy, Holmes ran into Emerson on the street and said, in no uncertain terms, “If I do anything, I shall owe a great deal to you.”  Holmes was more right than he probably knew. 

Holmes, who never gave himself over to ontological (or deontological) ideas about law as an existent, material, absolute, or discoverable phenomenon, bloomed and blossomed out of Emersonian thought, which sought to “unsettle all things”[13] and which offered a poetics of transition that was “not a set of ideas or concepts but rather a general attitude toward ideas and concepts.”[14]  Transition is not the same thing as transformation.  Transition signifies a move between two clear states whereas transformation covers a broader and more fluent way of thinking about change.  Holmes, although transitional, was also transformational.  He revised American jurisprudence until it became something it previously was not.  Feeding Holmes’s appetite for change was “dissatisfaction with all definite, definitive formulations, be they concepts, metaphors, or larger formal structures.”[15]  This dissatisfaction would seem to entail a rejection of truth, but Emerson and Holmes, unlike Rorty and the neopragmatists much later, did not explode “truth” as a meaningful category of discourse.  Read the rest of this entry »

He has taught English in middle school, high school, and college, and is currently taking care of his children at home. He is the author of Diaphysics, an interdisciplinary work on systems philosophy; other projects include the application of F.A. Hayek’s spontaneous order theory to ethics, the arts, and literature. Introduction

In the unbelievable and unknown –
In the unrefined and those without thought –
In the unremarkable and unwise –
We find our leaders
We find our heroes
We find our artists
I see it – there is a sun on the horizon –
The rosy fingers of an ancient dawn –
A rebirth of everything from everything we have torn apart –
A world in fragments – no longer a world –
Fragments gathered up –

An Astrology

I stand, stare at the Cantor dust of stars,
Stand alone in the open field of grass
That glows in the silver of the moon brass
And dark emerald under a rising Mars.
I wage a silent war within my mind
As I wait in vain for a happiness
